Das Recht der öffentlichen Wiedergabe im Lichte der Dienstleistungsfreiheit

This work is dealing with the conflict between Geoblocking in the EU and the principle of the internal market from a copyright perspective. The work focuses on the question, whether the prevailing interpretation of the right of communication to the public, on which the common practice of territorial exploitation of copyright protected content is based, is in line with the freedom of services. It concludes that an interpretation of the right of the communication to the public in line with EU primary law is necessary. This challenges territorial exploitation schemes and with that the use of Geoblocking in the EU.
