The book explains the new rules on trust services for electronic transactions – such as electronic signatures, seals, time-stamps, registered delivery services, and services for preservation and validation. It introduces the eIDAS Regulation of the EU which has been applicable in all member states since 1 July 2016, and it describes how the Regulation interacts with national law. The eIDAS Regulation may have primacy in application over German law, but not in validity. German law remains in effect, but it is not applicable if it contradicts the eIDAS Regulation. The book offers legal certainty by demonstrating which German provisions on signatures, electronic forms and proof remain applicable. It also offers numerous leads on how a German amendment act could reduce application problems.
