Description
The Right to Be Heard is a cornerstone of procedural guarantees under national law in all European states. Its importance expands also to the level of European law, especially as a part of the protection of European fundamental rights. In the jurisdiction of the European Court of Human Rights and the European Court of Justice, the Right to Be Heard emerges as a prominent fundamental right and defines the standards for fair judicial proceedings throughout Europe.
This study unfolds and systemizes the current status of this fundamental procedural right in European law by examining the legal bases of the Right to Be Heard both in the European Convention on Human Rights and in European Union law. Furthermore, it examines the interpretation and application of the right in the jurisdiction of the ECtHR and the ECJ in the light of the impending accession of the EU to the ECHR and the future relationship of the European courts.
