Description
The Europeanisation of Private Law is one of the most important legal developments today. Sales law and remedies for breach of contract, in particular the remedy of termination, have been part of this development ever since. The author examines the remedy of termination in historical-comparative perspective. To this end he takes a closer look at three of the main European jurisdictions: England, France and Germany. These jurisdictions have been undergoing rapid change – take, for example, the French reform of the Code civil in 2016. The treatise also includes an assessment of the model rules CISG, PECL, PICC, DCFR and CESL. The findings can be applied when reforming the remedy of termination. Along this path the book facilitates an “organic” harmonisation of European private law. The insights are relevant for everybody who takes a European approach to private law.
