In recent years, a shift can be observed in international economic relations: instead of further market liberalization, skepticism towards foreign investments has grown. Investment screening mechanisms restrict market access on the grounds of security and public order. However, these may conflict with international investment law. This study examines whether adverse investment screening decisions can give rise to investor-state arbitration. Against this background, it explores the boundaries of states’ security interests under international economic law.
