Description
The principle of territoriality poses major challenges for the business world in patent law. While patents continue to be designed as territorially limited property rights, many inventions today focus on computer-based processes and systems that can be used across national borders. This thesis examines the extent to which the cross-border use of process and system claims triggers liability for domestic patent infringement, taking into account the principle of territoriality. The different forms of cross-border use are identified and examined in a practice-oriented manner using a wide range of examples from application and granting practice.
