The paper examines the Agreement for the Termination of Intra-EU BITs, which fundamentally changes the intra-European investment protection system. In the analysis, a distinction is made between legal and factual elements. The legal assessment provides answers to the questions whether the treaty-based investment protection regime has been effectively terminated and whether the systematic change resulting from the termination is sustainable. The factual analysis shows which concrete consequences result from the termination of intra-EU BITs. Finally, the review of both elements allows for a concrete recommendation for action and an outlook on future intra-EU investment protection law.
