Das Unionsrecht in Vollstreckungsverfahren von Schiedssprüchen vor außereuropäischen Gerichten

The work examines the role of European Union law in the enforcement process of international arbitral awards before courts outside the European Union, using the enforcement of intra-EU investor-state arbitral awards in the United States as a case study. It explores the interaction between EU law, public international law, international arbitration law, and domestic procedural law in the context of cross-border enforcement proceedings. Drawing on its findings, the study develops a conceptual framework for the enforcement of intra-EU investment arbitral awards in the United States and proposes a broader systematic approach to the consideration of EU law in enforcement proceedings before non-EU courts.
