Das Verbot der Benachteiligung wegen der Gewerkschaftszugehörigkeit

The fact that discriminatory practices are used against members of employee representative bodies in an attempt to undermine co-determination is by no means a new phenomenon when it comes to the discrimination faced by works council members. The prohibition of discrimination on the grounds of trade union membership, however, has so far received little attention in German labour law scholarship. This doctoral thesis therefore contributes to the legal clarification of this issue, the resulting conditions and legal consequences, as well as possibilities for the further development of protection against discrimination. In this regard, not only national law but, in particular, international labour law is drawn upon as a source of knowledge.
