Das Verbot einer verfassungswidrigen Gewerkschaft

The defensibility of German democracy becomes especially important in times of increasing extremist currents in society. Therefore, this paper addresses whether and how the Federal Republic can ban an anti-constitutional labor union, which is further complicated by the special protective status of coalitions in the German constitution and the thin regulatory situation under German law. In this context, the author investigates the freedom of trade unions and its limits, as well as presents in detail the constitutional barrier on the basis of which a ban on trade unions is possible. She also shows conceivable practical scenarios for banning unions and offers a proposal for a more transparent legal situation.
