Das Vergabeverfahren der Innovationspartnerschaft

The innovation partnership was introduced as an additional procurement procedure with the 2014 EU procurement law reform and incorporated into German law with the 2016 Procurement Law Modernisation Act. It links research and development with specific procurement and includes specifications for the procurement procedure and contract execution. This paper examines the legal framework of the innovation partnership, highlighting opportunities and limitations in the procurement procedure and in the execution of the contract after the award. Parallels and differences with the negotiated procedure and competitive dialogue are identified, and the practical implementation of the procedure is discussed on the basis of selected aspects.
