‘Today’s judiciary is becoming a source of uncertainty.’ Beginning with this statement, this book defends legal positivism. It is based on the author’s practical experience of interpreting and applying the law as a judge at Brazil’s constitutional court. To conclude his study, the author warns that the modern judiciary is jeopardising the objectivity of the law. He emphasises that constitutional states have become judicial states and that, in the end, democracy can only exist if judges restrict themselves to being servants of the law.
