Description
The European Union is moving away from the pure protection of personal data and promoting the use of data through the European Data Strategy. The Union sees potential in the use of IoT data, which the Data Act is intended to make available. Insofar as this involves personal data, the intended use of the data conflicts with the General Data Protection Regulation. Even the conflict-of-law rule chosen by the Union, according to which the GDPR is to remain unaffected, cannot hide this fact. This work examines the relationship between the two regulations and provides an outlook on possible forms and limits of data use.
