Demokratische Legitimation im Verbund der Energieregulierung

The network of independent agencies for the regulation of the European internal electricity market creates numerous challenges for the democratic legitimation of administrative activities. The author addresses these challenges in this study and compares the concepts of legitimacy underlying the German constitution and the EU treaties. On this basis, the author shows which elements and mechanisms can be used to reduce the conflicts resulting from the different conceptions of legitimacy in the context of the ongoing legislative development of the regulatory framework for grid-based energy, which is now pending at the national level.
