This book is concerned with the amicus curiae brief in international investment arbitration. Despite the implementation of Rule 37(2) in the ICSID Arbitration Rules in 2006 and despite various decisions by arbitral tribunals, the participation of amici curiae in arbitral practice remains a contentious issue. Therefore, contemporary issues concerning the participation of amici curiae are tracked and analysed in depth.
In particular, the author analyses amicus curiae provisions in investment treaty law and the given case law. A main focus is placed on finding ways to improve the current legal frame work. Specific suggestions for improvement are made as well as clear recommendations for action directed to the main players in international investment law.
