Der Anspruch auf Ersatz immaterieller Schäden bei Persönlichkeitsverletzungen juristischer Personen des Privatrechts

Legal entities under private law generally enjoy protection of their personality rights under civil law in Germany, Switzerland, and Liechtenstein. Whether they are also entitled to compensation for non-pecuniary damages in the event of a violation of their personality rights, as are natural persons, is a matter of debate in all three legal systems. While the case law of the Federal Court of Justice has not yet provided a clear answer under German law, the Swiss Federal Supreme Court has consistently recognized such a claim for legal entities as well. This thesis examines the arguments presented in case law and legal scholarship and develops a unified proposed solution for the three legal systems.
