Description
The PflegeZG (Home Care Leave Act) is the legislator’s reaction to demographic changes in Germany. His intent is to support home care by family members, which is preferred by many of those dependent on nursing care, thus unburdening nursing care insurances. However, the implementation has largely been unsuccessful and is proving difficult to understand for users and practitioners. How does the heavily criticised law actually help caregivers reconcile work and care for relatives? Has the legislator gone too far in establishing special protection against dismissal for employee-like persons? This thesis examines these questions, explores open legal questions and weaknesses, and investigates how the new guidelines are being incorporated into the current regulations of employment, social and civil law. Further approaches relevant to caregiving will be examined with respect to feasibility. Furthermore, the dissertation will provide original suggestions and possible solutions to improve the status quo.
