In modern business, geographic boundaries are increasingly dissolving. What remains are directives and reporting lines that link single employees and operating resources. Jan Alexander Daum examines the extent to which lines of instruction shape the "Betrieb", which is one of the most important elements of German labor law and characterizes co-determination law, protection against dismissal and the transfer of undertakings. To this end, he distinguishes between different types of management powers that constitute the respective organisation. He is proving his organisational-teleological approach in so-called matrix organisations, in which management powers for the same employees are distributed over several instances.

»Das fundierte Werk von Jan Alexander Daum stellt nicht nur eine gute Zusammenfassung, sondern vor allem auch eine Schärfung der bereits vorhandenen arbeitsrechtlichen Diskussion zum ›Betriebs‹-Begriff und seiner Funktion in matrix-organisierten Unternehmen und Konzernen dar. Es bietet darüber hinaus gute und belastbare Argumente für die damit zusammenhängenden Grundsatzfragen etwa für die Definition des Betriebs für die daraus folgenden Konsequenzen für die Betriebsratswahlen und vor allem auch für den Betriebsübergang nach § 613 a BGB. Das Werk ist auch für die Unternehmenspraxis als Beratungsgrundlage für M&A-Diskussionen gut geeignet, weil es auch Gestaltungsfragen für Praktiker anspricht. Daums Dissertation ist also inhaltlich hoch zu loben.«
