Der Eingriff in nicht vollständig erfüllte Vertragsverhältnisse im deutschen Restrukturierungsrecht nach dem StaRUG

This thesis examines one of the most controversial restructuring tools under the StaRUG—one that is debated both in academic circles and in practice—namely, the intervention in contractual relationships that have not been fully performed. It first examines the constitutional aspects of the two main variants of this instrument. In doing so, the study highlights in particular the differences from insolvency proceedings and §§ 103 ff. InsO. In addition, the relevant provisions of foreign legal systems, namely those of the Netherlands, England and the USA, are analysed from a comparative law perspective. The findings are then incorporated into a separate legislative proposal.
