The European Arrest Warrant (EAW) is by far the most successful instrument of European Criminal Law to date. It does, however, have an Achilles' heel, which has concerned politicians, researchers, and practitioners for years: its disproportionate use on minor crimes, such as the theft of a bottle of beer, or other cases of extraordinary hardship, such as the extradition of minors and pregnant women. This book advances the quest for a solution by pursuing the question of why, and in which cases, EAWs are applied disproportionately. It also analyses whether and in what ways the solutions favoured by EU institutions can be improved considering the tension between mutual recognition and human rights. The book takes a practical approach and puts special emphasis on alternative measures to the EAW and the question whether these really represent attractive alternatives in practice.
