The work examines the factor of time as an element of the rule of law and in particular the question of how timely legal protection can be determined. The legal assessment of the factor of time is characterised by the multilayered interests of the holder of fundamental rights in the correct procedural result within a reasonable period of time as well as by the interests of the public authority in an effective an efficient implementation of procedure.
In order to make the factor of time legally manageable, Art. 41 and Art. 47 of the CFR are examined in a time-specific manner, the ECJ case-law on reasonable time limits is comprehensively analysed and the timerelated structure of antitrust and court proceedings is considered in detail.
