The required result of the work is caught in a tension between expectations of functionality, the scope of work, and compliance with accepted technical standards. The latter are at the center of the current legal policy debate surrounding so-called "Gebäutetyp E". This thesis addresses the question of how the existing tension within the required work performance can be resolved while simultaneously paving the way for innovative, more cost-effective construction. To this end, a new categorization of the contractor’s performance into three categories of performance objectives is proposed, with the aim of enabling new construction methods, avoiding economically pointless rectifications, and agreeing on legally secure deviations.
