Der Grundsatz des gegenseitigen Vertrauens im Mehrebenensystem der Europäischen Union

The thesis analyzes the development, legal qualification and significance of the principle of mutual trust for the (fundamental rights) EU multi-level system. For this purpose, the author examines the international law background, legal policy, legislation based on mutual recognition, and case law on the AFSJ. At a time when the rule of law in the Member States as a premise of (the principle of) mutual trust is eroding, the author discusses the interaction and tension between the normative duty of trust and actual trust between Member States, as well as the balance between the duty to trust to ensure cooperation efficiency and the duty of review to protect the individual.
