Description
The ECJ’s ruling on Huawei Technologies/ZTE of 16th July 2015 is of immense importance in the field of patent litigation. According to this ruling, the patentee of a standard essential patent who has given a commitment to the standards organization to grant third parties a licence for that patent on FRAND-terms has to meet certain obligations prior to filing a lawsuit. This thesis summarises the ECJ’s decision in a five phase model and defines its relationship to the German Federal Court’s (BGH) Orange Book Standard of 2009, which favoured the rights owner.
