With the implementation of the EU Restructuring Directive in the StaRUG, Germany has created a separate category of participants for small and medium-sized enterprises (SMEs) in the provisions on judicial company restructuring.
Alexander Holler analyses how the term "SME" is to be understood in StaRUG on the basis of the provisions of the Directive, the existing differentiations between participants and sizes and the practical requirements.
The term "SME" in StaRUG is now the key size differentiation for participants in German restructuring and insolvency law. On the basis of the identified SME concept, this volume proposes the creation of size-specific regulations for SMEs as debtors and provides initial examples.
