Schriften zum Insolvenzrecht
Description
The Act to Facilitate the Handling of Group Insolvencies introduced the coordination plan into the Insolvency Code as the central procedural instrument of the new coordination proceedings. The lack of binding force and additional costs have so far led to insolvent corporate groups not using the coordination plan despite a crossprocedural approach.
This work analyzes the suitability and requirements of a coordination plan as a successful procedural instrument. By evaluating national and international plan and procedure designs for groups of companies in insolvency, the author drafts a more binding and coherent concept for the coordination plan from the initiation to the conclusion of proceedings.
