The design of the personal scope of application of labour law, which is closely linked to the image of the industrial worker, is under strong pressure to adapt due to a working world that is constantly changing as a result of technological progress and social change. This work examines the extent to which a change in the status-related protection concept in labour law could enable an appropriate distribution of opportunities and risks in a modern and dynamic world of work on the basis of the framework provided by fundamental and European law and against the background of the functional conditions of labour and social law in the market economy.
