Der portage salarial – eine neue Beschäftigungsform für Solo-Selbstständige?

The portage salarial was developed in France about 30 years ago and promises a full inclusion of the solo self-employed in labour and social security law. This makes the portage salarial as a new form of employment interesting for German law as well and is the reason for the comparative legal study. The focus is less on a comparison of the systems than on questions of the classification and compatibility of the employment model with German labour and social law. Finally, the legal policy question of whether the portage salarial as a form of employment is suitable for guaranteeing labour and social law protection for low-income solo self-employed workers is examined.
