Der Sanierungsvergleich i.S.d. § 97 Abs. 1 S. 1 StaRUG und seine gerichtliche Bestätigung

The StaRUG came into force in January 2021 and created a legal framework for reorganisations outside of insolvency proceedings for the first time. In addition to the provisions on the restructuring plan, the act also contains provisions on restructuring facilitation and restructuring settlements, which initially received less attention. However, it is gradually being recognised that the restructuring settlement offers a low-threshold instrument whose potential is increasingly being explored in practice. This study analyses the requirements and effects of a court-approved restructuring settlement. The aim is to answer unresolved questions, lay the groundwork and develop practical solutions.
