Der Schutz der immaterialgüterrechtlichen Lizenz – Klageschutz, Sukzessionsschutz, Insolvenz - und Vollstreckungsfestigkeit

The dissertation examines the classification of intellectual property licences in private law and their legal effects. The intellectual property license cannot be clearly assigned to either property law or the law of obligations. The central question is whether such licences have so-called proprietary effects - namely the licensee’s right to sue third parties, protection upon succession, and protection in insolvency and enforcement proceedings. It further analyses the legal nature of the licence, the influence of property law principles, and these alleged proprietary effects in detail. The aim is to develop a doctrinally coherent and practically workable understanding of intellectual property licences.
