Description
As a cornerstone of constitutional democracy, freedom of expression has not only gained greater potential through the proliferation of online platforms. Recently, the ambivalent relationship between the creation and limitation of freedom has become clear, with platforms setting (invisible) limits on their users' freedom of expression in the exercise of their own fundamental rights. This conflict of fundamental rights must be resolved by the state, with various approaches being examined, ranging from direct fundamental rights obligations to regulation. The focus here is on national fundamental rights doctrine, although EU fundamental rights and European legal acts such as the DSA are also taken into account.
