Can the legal priviligation of agriculture still be justified under the existing legal framework? The protection of the efficient farm is a basic principle of German agricultural law. In this respect, agricultural law differs from the general rules of hereditary law, environmental law and family law. According to settled case law of the Federal Constitutional Court, these deviations are justified by the public interest in maintaining efficient farms in rural families. The conference proceedings examines the scope and limits of this principle.
