The protection of trade secrets in a fundamentally transparent civil proceeding presents a constant conflict between confidentiality and the access to information for secret holders, legal practitioners, and courts. This conflict becomes particularly evident in patent disputes, due to the close interaction between patents and trade secrets, which forms the starting point of this study. The book analyzes existing regulations and their gaps, explores new solutions, and proposes a specific approach for integrating trade secret protection into the Code of Civil Procedure (ZPO) through an “integrative confidentiality procedure”.
