Der Schutz vor der Herstellung und Verbreitung von Nackt- und Intimaufnahmen

The work deals with the challenges of image and privacy protection in the age of digitalization. The "Web 2.0", the increasing commercialization of nude and intimate photos or one's own digital handling of the private sphere pose enormous challenges to the current legal protection in place. The work first analyzes the current civil law, data protection and criminal law protection against the production and distribution of nude and intimate photos and subjects this to a comprehensive examination of whether current legal protection is able to keep up with digitization and technical progress. Furthermore, the effects of new phenomena (e.g. revenge porn, cyber-bullying) or the digital legacy on current legal protection are intensively dealt with. Finally, an outlook is given on how effective legal protection must be designed in the future in order to ensure proper privacy protection.
