While purpose-related substance protection has become established in practice for Second Medical Use claims, this work examines the question of the scope of protection against the background of novelty as a prerequisite for protection. To this end, the work examines Second Medical Use claims in light of the categories created by Section 9 PatG. The history of case law leading to a purpose-related substance protection is also analysed. The result is a dual categorisation as both a product patent and a process patent, which does justice to the special features of this constellation.
