The process for determining insolvency claims (Forderungsfeststellungsverfahren) is a key element of administration proceedings (Gesamtvollstreckung). The outcome of the claims determination process (Feststellungsverfahren) is binding for the concurrent creditors as well as the administrator pursuant to s. 178 (3) InsO. Where an entry has been added to the insolvency table, its effect is equivalent to an enforcable judgment in accordance with s. 201 (2, first sentence) InsO. This thesis examines the limitations to the influence and effects of the insolvency table posed by constitutional requirements. Particular focus is given to so-called “third party impact” (Drittwirkung) of the final and binding legal force of the insolvency table.
