The dissertation addresses the decades-old question of whether the works council is entitled to a general injunction in the event of operational changes. Through a thorough analysis of case law, literature, and legal requirements, considering constitutional and European law, the author identifies the limitations of the development of judicial law and proposes a practical solution to balance conflicting interests. Thus, the work makes an important contribution to the discussion on the scope of co-determination in the workplace and safeguarding the works council's participation rights in the event of operational changes.
