German copyright law is facing a systemic crisis: while new regulations increasingly aim at investment protection, the fundamental principles remain author-centered. This dissertation provides a comprehensive analysis of this transformation and demonstrates how the system has evolved into an excessive protection right.
Based on this analysis, reform proposals are developed that address both the range of protected works and future developments, particularly through contractual flexibility. Central approaches include the flexibilization of the creator principle, the introduction of a dualistic system with extended waiver options for moral rights, and registration-based protection periods.
