Description
At the beginning of the 19th century, in the legal framework set up by Art. 13 of the German Federal Act of June 8, 1815 and Art. 57 of the Treaty of the Congress of Vienna, the first “modern” constitutions were established in the Member States of the German Confederation, trying to find a balance between the opposing principles of constitutionalism and monarchism. However, in constitutional conflicts, the legal issues, which had only seemingly been solved, became the main questions of the legal disputes. Analyzing the original sources and the extensive literature, this doctoral thesis reveals the legal “read thread” of the constitutional conflicts of 1830 in Brunswick and of 1837 in Hanover and their parallel structures by examining the historic background, the triggering events, the legal opinions and political motives of the disputing parties and the Federal Assembly.
