Description
Few questions shape the debates on the welfare state, fundamental rights and redistribution more than how much distributive justice liberty needs and how much it can bear. This study offers a rational standard. Florian Hermanns reconstructs, strictly within the theory itself, the two core principles of John Rawls's Theory of Justice: liberty and iustitia distributiva as a system allocating rights and duties. He then tests their coherence. The result calls into question the familiar reading of the priority of liberty: just allocation constitutes real freedom. Using Rawls’s justificatory model, the author derives modified principles of justice.
