Description
The special nature of terrorists indicates a connection between advanced criminal liability and terrorist intention. Due to the structure of protected legal interests, terrorism criminal law is categorized as state security law. The core elements, such as endangering the state and violence, primarily manifest in intention. The legislator attempts to objectify this intention, which it succeeds in doing in the case of organizational offenses. In the case of individual offenders with no organizational ties, this objectification is again linked to an idea. For self-preparation, this intention should be interpreted as first-degree dolus directus, while for third-party preparation, it could be regarded as an element of awareness.
