Die Absprache zwischen dem Bundesamt für Migration und Flüchtlinge und den Kirchen zum Kirchenasyl

In 2015, the Federal Office for Migration and Refugees and the Christian Churches came to an agreement on how to deal with church asylum cases, which is of decisive importance in the current church asylum practice. The author places this agreement at the center of her considerations of constitutional law and thus focuses on the core of the current problem. She develops the argument that constitutional law allows the state and religious communities to conclude informal agreements, but that high requirements arise from the freedom of religion and the principles of equality. She also shows that such an agreement has legal effects due to the principle of the protection of legitimate expectations.
