Conventional litigation funding instruments are of little interest to claimants with substantial capital resources. One alternative is After-the-Event Insurance (ATE), which functionally strikes a balance between traditional litigation financing and insurance. This method of funding, which is already well established in England, has recently been gaining popularity in Germany as well.
This doctoral thesis compares the economic and legal circumstances for ATE in England and Germany and examines ATE as a legal product within the German legal framework. In addition, ATE is critically compared with traditional litigation financing and the current discussion on the need for regulation of third-party funding is addressed.
