A collective bargaining agreement can be declared to be generally binding – i.e., binding for all employment relationships within its scope – if it has become of predominant significance for the shaping of working conditions within its scope. This raises the question of when exactly this is the case, how this is determined, and how the responsible Federal Ministry of Labor can make this determination. This thesis explores these issues, examining not only the legal background of collective bargaining agreement and administrative law but also concrete data material for its suitability in determining possible predominant significance.
