Description
Based on the case law of the ECJ on limping same-sex marriage (Coman) and parenthood (Pancharevo, Rzecznik Praw Obywatelskich), the author examines whether and to what extent a Member State's obligation to recognize non-traditional statuses arises from Art. 21 (1) TFEU. Same-sex marriage, further non-binary gender options and the marriage of non-binary persons are taken as examples. Before these specific statuses are analyzed in more detail, the status quo of the obligation to recognize names under EU law is identified in order to contextualize the Coman and Pancharevo judgments.
