Die antizipierte Einladung zur militärischen Gewaltanwendung im Völkerrecht

The invitation of a state to use military force on its territory provides a legal basis under international law for the use of force by another state intervening on the invitation's basis. This principle is well-accepted in legal scholarship in the case of consent given ad hoc. However, particularly the more recent state practice gives rise to the question of whether, and if so under what conditions, this also applies to forward-looking consent given before the emergence of a conflict on an abstract basis. The book addresses this question by analyzing the sources of international law, including comparative legal findings from the dogmatics of consent in national criminal law.
