German law provides no clear mechanism for their adjustment of confirmed insolvency plans which are exposed to subsequent fundamental changes in circumstances. Friedrich Schlott fills that gap. He develops, systematically and for the first time, the analogous application of § 313 BGB to the insolvency plan, establishing a narrower notion of contract within § 313(1) sentence 1 BGB, a factual basis of the transaction grounded in §§ 244 et seq. and 220(2) InsO, and an integrated reasonableness assessment.
