The book deals with the question of the extent to which the principle of state sovereignty may be restricted in favour of the core rights that characterise journalism – freedom of expression and freedom of the press. Freedom of expression and freedom of the press are categorised as regional ius cogens. At European level, this means that the ECHR contracting states form an ius cogens legal community, which must become a ‘lawyer for human rights’ in the event of a violation of freedom of expression or freedom of the press and in this way is authorised, indeed obliged, to take third-state remedies.
