Pursuant to Section 327 (1) sentence 1 BGB, object of all contracts governed by Sections 327 et seq. BGB is the supply of digital products. The scope of such an obligation can be deduced from the provisions in Sections 327 et seq. BGB, because it is predetermined by the Directive (EU) 2019/770. The study deals with the question of how the supply of digital products relates to the characteristic obligations of the types of contract regulated in the BGB. This has a direct impact on the scope of application of Sections 327 et seq. BGB and Sections 433 et seq. BGB.
