The pre-behavior of a person is an important criterion in balancing the general right of personality and freedom of press. Since the recognition of the general right of personality, it has been subjected to numerous investigations and further developments. The criterion of pre-behavior of a person however has not been defined conclusively.
The author categorizes and classifies German and European jurisprudence in order to determine a more precise balance of this criterion. A definition of the pre-behavior is discussed. The main focus applies to the de-privatization and the re-strengthening of the general right of personality. Further, the author discusses the Right to be Forgotten and the Litigation-PR.
